Joint ownership disputes can arise in several different ways. Sometimes people purchase real property together and one party wants to sell, and the other party does not want to. Sometimes, two or more individuals inherit a piece of property and become joint owners. If you find yourself owning land with one or more other people and you want to sell your interest in that land, contact TDS. Generally speaking, owners of jointly owned property or fractionally owned property can sell his or her interest without the consent of the other joint owner(s). There could be exceptions if the vesting deed to the property or an agreement between the joint owners prohibit the sale of jointly owned property to someone else, but absent an agreement or deed restriction to the contrary, a half interest or partial interest in property can be transferred and sold.
